Homeschooling in Virginia: Notice of Intent Rules for Caroline County Residents
Quick answer: In Caroline County, home instruction starts with a written notice of intent to the Caroline County Public Schools superintendent. Virginia law sets an August 15 deadline each year, plus a subject list, proof the parent meets one of four options and evidence of progress by August 1 (Va. Code § 22.1-254.1).
This guide sticks to the process: what Virginia law asks for, what the Caroline County Public Schools (CCPS) form covers and what changes when you move into the county mid-year. It isn't legal advice. Confirm the details with the division office before you file, because it's the office that reviews your paperwork.
What Virginia law requires
Home instruction is governed by Va. Code § 22.1-254.1. It applies to any student who will have reached the fifth birthday on or before September 30 of the school year and hasn't passed the eighteenth birthday (Va. Code § 22.1-254.1).
The Virginia Department of Education (VDOE) sums up what a home-instructing parent sends to the local school division (VDOE):
- A notice of intent to home instruct.
- Evidence of meeting one of the four qualifying options.
- A list of the subjects to be studied for the coming year.
- Evidence of academic progress at the end of the school year, due by August 1 (VDOE).
The four qualifying options
The notice must show that the parent meets one of these options (VDOE):
- Option I: The parent holds a high school diploma or a higher credential (VDOE).
- Option II: The parent meets the teacher qualifications set by the Virginia Board of Education (VDOE).
- Option III: The parent provides a program of study or curriculum, which may be a correspondence course, a distance learning program or any other method (VDOE).
- Option IV: The parent provides evidence of being able to provide an adequate education (VDOE).
The home instruction handbook that CCPS links to adds some detail. A high school equivalency certificate such as a GED doesn't meet Option I, and what counts as evidence under Option IV is decided locally, so it recommends contacting the division before you file (Home Instruction Handbook).
How to file in Caroline County
CCPS posts its forms on its Home School Information page: the Notice of Intent Form, the Home Instruction Handbook, the school attendance section of the Code of Virginia and driver education information for students taught at home.
The current CCPS form is for the 2026-2027 school year. It asks you to list each student's birth date, grade level and current school, check one qualifying option and attach the matching paperwork (CCPS Notice of Intent, 2026-2027):
- Diploma option: a copy of the high school, college or university diploma, plus the subject list (CCPS form).
- Teacher option: a copy of a teaching license or a VDOE statement, plus the subject list (CCPS form).
- Curriculum option: a notice of acceptance or other proof of enrollment in a correspondence or distance program, or a subject list if you're providing the curriculum another way (CCPS form).
- Adequate-education option: a statement explaining why you're able to provide an adequate education, plus the subject list (CCPS form).
The form goes to the CCPS central office in Bowling Green, and it lists an email address and the division phone number for questions (CCPS form). The same office handles notices from every part of the county, whether you live in Ladysmith, Ruther Glen, Port Royal or Lake Caroline.
Moving to Caroline County mid-year
The August 15 deadline is built for people who already live in the division. If you move into Caroline from Spotsylvania, Stafford, Fredericksburg or anywhere else after the school year has started, the law says to notify the superintendent as soon as practicable and then meet the rest of the requirements within 30 days of that notice (Va. Code § 22.1-254.1). VDOE describes the same rule (VDOE).
So if you're buying a home off Route 301 or Route 2, put "file the notice with CCPS" on your moving checklist next to utilities and the DMV. My Caroline County first-time buyer checklist covers the rest of that list.
Evidence of progress each August
By August 1 after each year of home instruction, the parent sends one of two kinds of evidence (Va. Code § 22.1-254.1):
- A composite score in or above the fourth stanine on any nationally normed standardized achievement test, or an equivalent ACT, SAT or PSAT score (Va. Code § 22.1-254.1).
- An evaluation that the superintendent accepts, such as a letter from a licensed teacher or a person with a master's degree who knows the student's progress, or a report card or transcript from a college, distance program or correspondence school (Va. Code § 22.1-254.1).
If evidence isn't provided, the program may be placed on probation for one year with a remediation plan. The evidence requirement doesn't apply to a student under age six as of September 30 of the school year (Va. Code § 22.1-254.1).
